Hi. We were married for two years when my wife left me to start a new relationship with someone else. We have only been separated for two months but we are both eager to move forward. Is it too soon to be able to apply for a divorce?

Hi Darren, thanks for getting in touch. You can get divorced if you have been married for at least a year. At the moment, there are five options the government give for the reason the marriage has broken down; unreasonable behaviour, adultery, two years separation (both of you agree to the divorce), five years separation (only one person has to agree to the divorce) or desertion. In your case, your potential two options are adultery or unreasonable behaviour. Or, if you'd like to wait you can use two years separation.
