What happens to the house in a divorce?

Just wondering as me and my wife are quite far through getting divorced who gets the house and is it split 50/50?

Your property or other assets/debt doesn’t necessarily need to be divided 50/50, but it will depend on your circumstances and other agreements. There is no defined formula for splitting assets in divorce. If you need help negotiating an agreement, we offer negotiation services. The other option is to decide between yourselves in a kitchen table agreement once you’ve gathered your financial information and shared it with each other. You can then get this made legally binding through a consent order. We also offer fixed-price drafting services for couples who are in agreement.

To ensure that your agreements are fair for both of you, think about what the courts in England & Wales take into consideration:

  • the needs of any children
  • your financial needs
  • your earning capacity
  • the contribution you have made (staying at home to raise children counts equally to earning money outside of the home)
  • the length of the marriage
  • your age
  • any health considerations
