Revoke final order before sealed

I had my final hearing on tuesday where after listening to both parties (as there was not much in the pot)( as presented by my ex) judge gave the order that I keep the matrimony and take over the mortgage and pay cgt( which my ex said is too much and he cannot afford) she also said that she was not a tax expert so I should consult an accountant to get better idea. And gave me 2 weeks time. When I spoke with few accountants and solicitors they all said there is no cgt in transfer between spouses. And also they found out that my ex had provided the cgt numbers of other properties very exaggerated, which is also incorrect the way he has calculated it. So I want to go back to the court and request them to reconsider their decision before it is sealed.I also want to know how should I approach the court. Would really appreciate a quick response. thank you

Hello,

Thank you for your question.

I'm sorry to hear you're struggling with your financial arrangements.

We're a couple service; we work with both people to help them reach a fair and balanced agreement outside of acrimonious court proceedings. As you're at the final hearing stage of contentious proceedings, this isn't something we can help you with or provide specific advice on.

Here are some organisations who can help you:

  • Lightning Reach - for people struggling to afford independent legal advice
  • Free Legal Answers - this service provides free legal answers
  • Law Works - you can find a pro bono solicitor through a law clinic near you on the Law Works website. A law clinic usually also gives free initial advice.

If you have children together and would like support in creating child-centred arrangements for them or navigating a specific issue, we offer a Separating with Children Service, a 90-minute joint session with an experienced Co-parenting Specialist.

We wish you the best of luck,

Tatiana
