Reading previous questions, realise that our mortgage was partly paid with some money that my husband's parents gave us. Can my husband refuse to give me half of the house value because of this?

Thanks for your message.
It sounds as though your husband has made mortgage repayments on your family home using money given to you both by his parents. Upon divorce a spouse may argue that they have made a greater financial contribution and therefore should receive more of the assets upon the divorce. Generally speaking the court considers financial and non-financial contributions to be equally valid and the person that has paid less during the marriage should not be penalised.
In most cases, the main aim is to ensure that both spouses’, and any children’s, future housing needs can be met regardless of who paid for what during the marriage. If you'd like to talk through your options with one of our experts then please book a call here.
