Hi - I would like to know if I can/should fill in an HR1 form. My husband has owned a 2 bed flat in London since 1999 (in his name only). Currently our 2 young adult children live in it. Should I fill in an HR1 form or is this only for if you live in the property yourselves?

Thanks for getting in touch with amicable.

The HR1 form is used to register something called home rights, which can help protect your interest in a home that’s in your spouse’s name if it’s been your marital home. Generally, it applies when you've lived in the property as a couple.

If you haven't lived in the flat yourself, it may not qualify as your matrimonial home, so registering home rights might not be possible in this case. But everyone's situation is a bit different, and it could be worth speaking with an advisor.
