Subject: Question About Pension Sharing, Disability, and Housing Needs

Hello,

I would appreciate some guidance on how my circumstances might be considered if I receive a pension sharing order as part of my divorce settlement.

I am disabled, unable to work, and unable to obtain a mortgage. If I receive a share of my spouse’s pension, I may need to access a substantial amount of it to buy a modest home, as this may be my only realistic way of securing suitable housing.

I understand that withdrawing a large lump sum from a pension to purchase a property could have tax consequences. It could also leave me with little or no pension provision for my future retirement.

When considering a pension sharing arrangement, can my housing needs, disability, inability to work, and inability to obtain a mortgage be taken into account? If I may need to use part of the pension to secure a home, how could this affect the advice or recommendations regarding a fair settlement?

I would be grateful for any guidance on this issue. Please also let me know what information or documents you would need from me.
