Form A Nature of Application

In Filling in the Form A Notice of intention to proceed with a financial application. The section called Nature of application is a little confusing, I want to clean break order by consent.. We have both agreed that as there are no assets to dispute, we have both moved on with our lives and have no need to seek maintenance from each other or divide pensions, but obviously want a clean break to prevent any future claims, what box would you tick as the type of order to apply for.

Hi Mike,

Thank you for your question. If you are applying for a clean break order this section of the form can be a bit confusing. We’ve seen two approaches to filling in this section, both of which are being accepted by the court. Firstly you could tick all the boxes for the different types of financial orders (to formally raise all of your financial claims) and then the consent order dismisses those claims. Alternatively, do not tick any of the types of order boxes and instead simply write next to the boxes ‘dismissal of all financial claims’.
