Can a judge reject a clean break order?

My ex and I agree to keep what we have (married 5.5 years and separated for 4 years) as we always kept them separate

Can the judge reject clean break order we agreed in case of difference in value of assets? Can they award one of us assets to even out the difference? And how big does the difference in assets have to be for them to reject our order - 50k, 100k or more?

Hi Soke, a consent order is an order made by consent and therefore a Judge is not there to interfere, but equally, they are not simply a rubber stamp and will need to ensure your agreement is fair in the eyes of the law, which depends on several factors, such as whether both your needs are met given the clean break.

Need advice on upcoming clean break order in case judge rejects and what I can do. Have a separation agreement and no issues with our decision made for myself to get 100 percent of housesale to rehouse myself , 20 years old son and 2 dogs. I also have been paying all household bills including mortgage with zero money from my ex husband. He had stated he could not afford to pay half due to his new partner he lives with in a council house.
