Common law marriage doesn't exist in England and Wales.
Nearly half of couples living together think it protects them. It doesn't.
If you've been living together for years, own a home together or have children together, you might assume the law treats you like a married couple. It doesn't.
A cohabitation agreement is how you make sure where you both stand is written down – what each of you owns, what each of you contributes and how you'd want to handle bigger changes.
One document. Drafted by a Specialist. Signed by both of you.

- Covers the full financial picture – not just the ownership split on the day you move in
Not sure if this is right for you? The consultation is free and there's no obligation.
What most couples don't realise

- 01
"We've lived together for years. Surely that counts for something?"
The length of your relationship doesn't change your financial rights to each other's assets. No automatic entitlements build up from living together.
- 02
"We own a home together. That means we're protected."
A deed of trust records who owns what percentage of the property. It may not cover contributions you've made since then – renovations, mortgage overpayments, periods one of you stopped working. And it says nothing about the rest of your finances.
- 03
"We have children together. That must give us some rights."
Children's law and relationship law are separate. You may have parental rights. Having children doesn't give you automatic financial rights over each other's assets.
- 04
"We've talked it all through. We know what we'd do."
A conversation isn't a legal document. Writing it down makes it real — and gives you both something to refer back to.

Will this feel like we're planning for something bad to happen?
Most couples tell us it feels like the opposite. It's the conversation you've been meaning to have, written down properly. Once it's done, it's done.
Is it actually legally binding?
Cohabitation agreements are treated as contracts under English and Welsh law. Courts consider whether both of you entered the agreement freely and understood what you were signing. Our process is designed around exactly those principles.
Does it work if only one of us owns the property?
Yes. It works for couples renting, couples where one person owns the home and couples buying together. It's not limited to property ownership.
How long does it take?
Most couples receive their drafted agreement within one to two weeks of the review session.
What if we haven't fully agreed on everything yet?
Our Living Together Planning Session is a 60-minute joint session with a Specialist. Add it at any point.
Can we use this if we live in Scotland or Northern Ireland?
Our service is only available to couples in England and Wales – cohabitation law works differently elsewhere in the UK, and we wouldn't want to give you the wrong guidance. If you're based outside England and Wales, we'd recommend finding a family law solicitor in your area who can help.
